1. Eligibility

You represent and warrant that:

• You are at least 18 years of age and authorized to use the Platform on behalf of the organization you represent.
• You have full power and authority to bind your organization to these Terms.

We do not collect any sensitive personal data, system-level logs, or conduct automated scans.

2. Nature of Service

Dataraksha provides:

• A structured self-assessment questionnaire aligned with the DPDP Act.
• A compliance score and readiness insights based on submitted responses.
• Personalized recommendations based on organizational context.
• Access to role-based dashboards summarizing the compliance position.

Note: The Platform does not provide legal advice and is not a substitute for consultation with legal professionals. The scoring and recommendations are generated based on user inputs and should be interpreted as indicative tools to support compliance efforts.

3. User Responsibilities

You agree:

• To provide accurate, truthful, and up-to-date information during registration and in the questionnaire.
• To use the Platform solely for internal, lawful, and non-commercial compliance assessment purposes.
• Not to misrepresent your identity or organization.
• Not to attempt to copy, scrape, reverse engineer, or misuse any part of the Platform.

You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.

4. Data and Privacy

• All information submitted through the Platform is handled in accordance with our Privacy Policy.
• We do not collect sensitive personal data beyond what is necessary for assessment.
• Your questionnaire responses remain your property. However, we may use anonymized, aggregated data for research and platform improvement purposes.

Consent: By using the Platform, you consent to data collection, storage, and processing as described in our Privacy and Cookie Policies.

5. License and Platform Access

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the intended purpose.
You may not:

• Resell or redistribute Platform access or outputs.
• Use the Platform for commercial analysis of third parties without our written consent.
• Upload malware or disrupt service availability.

6. Intellectual Property

• All content, including but not limited to questionnaires, scoring algorithms, dashboards, branding elements, and underlying software, is the exclusive property of Dataraksha and Datacharya.ai.
• You may not copy, distribute, or modify any part of the Platform without express written permission.

All rights not expressly granted herein are reserved.

7. Service Availability and Changes

We strive to ensure high availability, but:

• The Platform may be suspended temporarily for maintenance or upgrades.
• We may modify or discontinue features with or without notice.

We are not liable for any data loss, delays, or disruptions in service, especially in beta or trial phases.

8. Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied, including:

• Merchantability or fitness for a particular purpose.
• Accuracy or legal sufficiency of the compliance score.
• Suitability of recommendations without legal review.

Your use of the Platform is entirely at your own risk. You are advised to consult your legal, IT, or compliance teams before taking any decisions based on the output.

9. Limitation of Liability

To the maximum extent permitted under applicable law, Dataraksha, its affiliates, founders, employees, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, business interruption, data loss, or reputational harm
• Any decision made or action taken by you in reliance on the Platform’s content

In all cases, our total liability shall not exceed the amount paid (if any) by you for the use of the Platform in the 12 months preceding the incident.

10. Third-Party Links

The Platform may contain links to third-party services, tools, or regulations. We do not control or endorse them and are not responsible for their accuracy or security. Accessing them is at your own discretion.

11. Account Suspension or Termination

We reserve the right to suspend or terminate your access if:

• You violate these Terms
• You attempt to breach platform security
• We suspect misuse or fraudulent activity

Upon termination:

• Your access will be revoked
• Any data you submitted may be deleted or archived securely
• These Terms shall survive with respect to liability, IP, and governing law

12. Modifications to Terms

We may update these Terms from time to time to reflect changes in law, platform features, or business practices. Changes will be posted on our website and may be notified via email. Continued use after updates constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
